The document referred to below constitute a legally binding agreement between you and Gatsby Jewellery Ltd (“Gatsby Ltd”, “we” or “us”) which operates the Internet website with the domain name www.gatsbyjewellery.com (the “Site”).

It documents your rights and responsibilities and ours with regards to (a) your access to the Site; (b) your use of the Site; (c) any communications sent from Gatsby Ltd; (d) all information, products, software, services, and materials contained on our site.

By entering the Site you unconditionally accept the terms and conditions in this Agreement (set out below) and any future alterations we may make subsequently.

Please note that our website terms and contracts which sets out the sales contract is only offered in English.

Anyone who enters our Site is deemed a user (“User”). You are free to enter the site whenever you wish whilst adhering to all the relevant terms and conditions.

The use of this website is permitted for personal use only. Please remember that it is illegal to re-publish, sell, reproduce or otherwise exploit any items on our site for material purposes from this website, or create any item based on the content of this site.

You alone are absolutely responsible for any information sent to us and its accuracy and validity. You agree that you will not use and that you will not allow the use of any device or method that could possibly interfere with our Site. You may access and view the Content appearing on this Website for personal, non-commercial use only.

 

CONTENT

Any information, content or opinions given on our website are purely subjective and we cannot guarantee its fitness for purpose or accuracy.

The contents of the Site, do not represent any form of advice by us and is not intended to be used as such. We reserve the right to change the content at any time and will not be held liable for any failure of software during a purchase or at any time whilst using our site. In the event that an item is sold on our premises at the same time as it (being the same item) is sold online, we reserve the right to cancel the internet sale without liability.

 

How to use the website:

MAKING A PURCHASE

The price you pay is displayed on the website at the time we receive your order, however, while we try to ensure that all prices on our website are accurate, errors may occur. In the event of a pricing error, we reserve the right to offer you the item at the correct price, or cancelling the order and sending you a full refund. Furthermore we reserve the right to refuse sale to anyone, without explanation.

It is to be noted that we are under a legal duty to supply goods that are in conformity with the sales contract/description and undertake to uphold this legal duty.

Please be absolutely sure you wish to purchase an item before you commit to buy it. If you fail to contact us with payment details by the agreed date, the item will no longer be reserved for you and will be offered to other potential clients.

 

DELIVERY AND HANDLING

All items bought through our website are delivered worldwide free of charge and fully insured at the risk of the Gatsby Ltd.

For purchases within the UK we use Royal Mail Special Delivery and for international purchases we use either Royal Mail International Business Tracking and Signature Services, DHL ‘Express’ or Malca-Amit Ltd. 

Prices quoted are inclusive of taxes. Please note that local taxes and duties in your country of residence, should the same be outside of the United Kingdom, may apply. We undertake to deliver jewellery that is purchased on our site within 1-2 working days within the UK, 3-5 working days within Europe and 5-7 working days worldwide. If you require a faster delivery service we do have other options available on request.

 

TAXES

Sales are predominantly made under the Margin Scheme and therefore tax and duty exempt in Europe. On international orders, the customer is responsible for all additional duties, taxes and/or tariffs that may incur.

 

GUARANTEE

To enable you to see and examine any item we operate a ‘no quibble’ 14-day full money back guarantee on all online purchases. This uphold your right as a consumer to cancel a distance sale contract at any time within 14 days without giving any reason, and without incurring any liability except for the costs of returning the goods. The 14-day cancellation period ends at the end of 14 days after the day on which the goods come into your possession or the possession of a third party who you have nominated to take possession of the goods. This naturally assumes the item(s) are returned in the same condition we sent it in. The only cost to you being the return shipping/delivery, we will not reimburse any item purchased from us until it is received by us in the same condition that we sold it in. Please note that should you cancel the sales contract due to the goods being of unsatisfactory quality, not fit for the particular or not be as described, we will reimburse the costs of returning the goods to us.

 

Our sales contract includes a term set by consumer protection legislation that (1) the quality of our goods are satisfactory, (2) if before the contract is made, you expressly or impliedly make us know any particular purpose for which you are purchasing the goods, that the goods are reasonably fit for that purpose, whether or not that is a purpose for which goods of that kind are usually supplied and (3) that the goods will match the description. Should we breach any of the aforementioned terms relating to quality, fitness for purpose (if applicable) and/or description, you have the right to reject the goods, cancel the sales contract and return the goods to us at our expense. It is to be noted that the right to reject the goods applies for 30 days beginning with the first day after these have all happened: (1) ownership or possession of the goods has been transferred to you and (2) the goods have been delivered. Please note that as a consumer you have the right to request that we replace or repair goods that breach the aforementioned terms relating to quality, fitness for purpose (if applicable) and/or description. Should we not repair or replace the goods (for example, because repairing or replacing the goods is impossible or disproportionate, or don’t do so within a reasonable time and with significant inconvenience to you, or after one repair or one replacement, the goods do not conform to the sales contract, you have the right to a price reduction or the right to reject the goods. Should you reject the goods in such circumstances, we will bear the delivery costs incurred by you in returning the goods to us.

 

Please remember you are buying a piece of antique jewellery which must be treated with care. Some of these items are not suitable to wear whilst gardening, washing / showering, playing sport etc. Foil-backed items must not come into contact with water as this will cause discolouration. The items offered for sale on this site are antiques in good condition and with careful treatment should remain that way.

 

RETURNS / EXCHANGES

Please contact us to let us know of your intention to return or exchange the item and send it back via a secure and insured service within 30 days.

The refund will be in the same form as the original payment. If paid via credit card, please allow a few days once the refund is processed to show on your statement, depending on your issuing bank.

If the returned item is a ring that we have re-sized for free, then we will deduct the cost of sizing from the refund amount, at a fixed cost of £40.00.

 

For international customers, you are responsible for arranging to have the item(s) returned to us, and for any costs incurred. Please mark the package as ‘Return of sample merchandise, origin UK, item over 100 years old’. We strongly recommend that you use DHL to return your items to us, as we are not responsible for items which do not reach us.

It is the responsibility of the international customer to label the returned package correctly as returned goods, so as to avoid any unnecessary charges when re-entering the UK. If there are any charges incurred for returned items, that are out of our control, such as import duties, then these will be deducted from the refund amount.

Please be aware that international customs duties, sales taxes are NOT refunded for shipments outside the European Community (EU).

 

LAYAWAYS

You are required to leave a 10% non-refundable deposit for layaway items with the balance paid over an agreed flexible time frame.

The 10% deposit will not be returned if the customer cancels the sale.

If a customer is uncontactable after a period of two months the layaway will be cancelled and the balance retained.

Returns on layaways are refunded as store credit. 

 

PRIVACY POLICY

We are committed to protecting your privacy and will never give your details out to any third party without your expressly asking us to do so. We will store your personal data in accordance with the Data Protection Act 2018. 

All transactions are strictly confidential and we will not have access to your credit card details. All online transactions will be made through our online partner, Barclaycard. Some settings prohibit comprehensive determination of gem quality and carat weight. In order to avoid damaging old and sometimes delicate items by removing a gemstone, we will provide approximated information. In such instances, descriptions must be considered estimated and/or an opinion. Unless otherwise stated, all coloured gemstones and pearls are assumed to be subject to a relatively stable and possibly undetected colour or clarity enhancement. All our diamonds are natural and untreated.

Dating jewellery is an inexact science. To the best of our ability using our knowledge and experience of antiques, we can give a close approximation of the date when an item was manufactured. Our method of analysis includes studying the materials used, how the item was made, hallmarks, signatures and the overall style. All descriptions are made in good faith, but the information provided does not represent a warrantee or guarantee and therefore any reliance you place on the information provided is strictly at your own risk. 

Occasionally, pieces may go out of stock before we have removed them from the site. We will notify you should this happen. We make every attempt to only show the correct information, but sometimes mistakes are made. We reserve the right to cancel any order if the item is either no longer in stock or if we have made an error with regards to pricing.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.
